Welcome to Qrunch! These Terms of Service ("Terms") govern your access to and use of the Qrunch mobile application ("App") and related services (collectively, the "Services"). By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Acceptance of Terms

By accessing or using Qrunch, you confirm that you have read, understood, and agree to be bound by these Terms, including our Privacy Policy. If you do not agree, you may not use our Services.

2. Eligibility

You must be at least 18 years old to create an account or use the Services. By using Qrunch, you represent that you have the legal capacity to enter into a binding agreement.

3. Age Restrictions and Safety

NO USE BY UNDERAGE PERSONS. The Qrunch Services are intended ONLY for legal adults. NO PERSONS UNDER THE AGE OF EIGHTEEN (18) YEARS (OR THE AGE OF MAJORITY IN PLACES WHERE EIGHTEEN (18) YEARS IS NOT THE AGE OF MAJORITY) ARE AUTHORIZED TO ATTEMPT, DIRECTLY OR INDIRECTLY, TO VIEW, DOWNLOAD, POSSESS, OR OTHERWISE USE THE QRUNCH SERVICES.

YOU MUST BE A LEGAL ADULT. BY ACCEPTING THIS AGREEMENT, CREATING A USER ACCOUNT, AND ENTERING A DATE OF BIRTH FOR AGE VERIFICATION PURPOSES, YOU AFFIRMATIVELY REPRESENT AND WARRANT THAT:

YOU ARE CURRENTLY EIGHTEEN (18) YEARS OF AGE OR OVER (OR THE AGE OF MAJORITY IN PLACES WHERE EIGHTEEN (18) YEARS IS NOT THE AGE OF MAJORITY);
YOU ARE CAPABLE OF LAWFULLY ENTERING INTO AND PERFORMING ALL THE OBLIGATIONS SET FORTH IN THIS AGREEMENT;
YOU ARE NOT LOCATED IN A COUNTRY THAT IS SUBJECT TO A U.S. GOVERNMENT EMBARGO, OR THAT HAS BEEN DESIGNATED BY THE U.S. GOVERNMENT AS A “TERRORIST SUPPORTING” COUNTRY; AND
YOU ARE NOT LISTED ON ANY U.S. GOVERNMENT LIST OF PROHIBITED OR RESTRICTED PARTIES.

4. Safety and Interactions with Other Users

Qrunch does not control or verify the behavior, intentions, or identity of its users. You are solely responsible for your interactions with other members, both on and off the Qrunch platform. Qrunch makes no representations or warranties regarding the conduct or identity of any user.

Qrunch does not currently conduct criminal background checks or identity verification. We reserve the right to do so at any time using publicly available records.

Qrunch is a sex-positive platform. You may encounter content that some may find objectionable. You acknowledge responsibility for your choices when using the app and must assess any risks associated with your location and use.

5. Location Data Warning

As explained in our Privacy Policy, users who misuse the Qrunch App or spoof their location may attempt to determine your real location. Use caution and only share your location if comfortable.

Qrunch is not designed to be used while driving or in hazardous conditions, and is not intended as an emergency location tool. It should not be used for business, fleet tracking, or commercial purposes.

6. International Users

Qrunch is controlled and operated from South Korea. We do not guarantee the Services are appropriate or legal in all jurisdictions. You access them at your own risk and are responsible for compliance with local laws. You agree to the transfer and processing of your data in the country of operation and other jurisdictions as described in our Privacy Policy.

7. Guidelines for Use; Prohibited Conduct

You agree not to:

Use Qrunch if you are underage.
Harass, abuse, or harm others.
Share private or explicit content without consent.
Use the app for commercial or non-personal use.
Engage in or promote illegal activities.
Attempt to harm or hack the app or other users.
Post pornographic, violent, hateful, or threatening content.
Violate another user’s privacy.
Share any content that includes minors in any form.
Use the app to distribute malware, spam, or AI training data.

Violations may result in content removal, account suspension, or permanent bans.

8. User Content and System-Generated Content

You retain rights to your User Content, but grant Qrunch a license to use it to operate and improve the Services. You may not post any content that you do not own or have permission to share.

Qrunch may use AI and algorithmic tools to assist with suggestions and moderation. Content found to violate these Terms may be removed at any time.

9. Third-Party Sites and Services

Qrunch may contain links to third-party websites and apps. We are not responsible for the content or actions of these third parties. Use of linked services is at your own risk. Your interactions with advertisers or partners are solely between you and them. Qrunch disclaims any liability from such relationships.

10. Advertising

Qrunch may display ads near your content. You will not be compensated for these advertisements.

11. Your usage

Qrunch reserves the right to monitor and restrict use of the Services. We may remove accounts for violations or inactivity. You are responsible for your conduct and content.

12. Termination

You may delete your account at any time. We may also suspend or delete accounts that violate these Terms without notice. We do not currently offer refunds, but may update this policy in the future.

How to Request Account Deletion

Users may request deletion of their account and related data at any time by following these steps:

Open the Qrunch app.
Navigate to App Settings > Account > Delete Account.
Follow the on-screen instructions to confirm the deletion request.

Data Subject to Deletion and Retention

Upon account deletion request, the following data will be handled as follows:

Deleted Immediately:
- Profile information (nickname, profile photo, age, height, weight, etc.)
- Social interactions within the app (likes, matches, messages, and related metadata)
- App usage data (login sessions, device information, location history)
Retained Temporarily:

For legal, security, and compliance reasons, certain user information may be retained, including but not limited to:
- Identification and authentication records (user ID, email, encrypted authentication data)
- Records necessary to enforce our Community Guidelines or resolve disputes.

Retention Period

Retained data will be stored for up to 180 days following account deletion. After this period, all retained data will be permanently deleted or anonymized, unless a longer period is required by applicable law.

If you use the Qrunch app via the Apple App Store, you acknowledge:

Qrunch, not Apple, is responsible for the app.
Apple has no responsibility for maintenance or support.
You must comply with the App Store Terms of Service.
Apple is a third-party beneficiary of these Terms and may enforce them.
